NOTICE OF PROPOSED CHANGES IN THE REGULATIONS OF THE DEPARTMENT OF COMMERCE, COMMUNITY, AND ECONOMIC DEVELOPMENT

The Department of Commerce, Community, and Economic Development proposes to adopt new regulations in Chapter 14 of Title 3 of the Alaska Administrative Code, dealing with the regulation of mortgage lending in accordance with Alaska Statutes 06.60, the Mortgage Lending Regulation Act, Chapter 50, SLA 2007, “the Act.” The proposed regulations address various aspects of the business of making mortgage loans under the Act, which provides for the licensing of mortgage lenders, mortgage brokers, and originators. “Mortgage loan” is defined in the Act at AS 06.60.990(19). The regulations deal with a wide range of subjects covered by the Act, including the registration, licensing, or exemption of persons engaged in activities related to the making of mortgage loans, originator competency testing and continuing education, license duration, renewal, inactivity, and surrender, licensee and registrant obligations and discipline, licensee and registrant restrictions, the examination and investigation of licensees and registrants, the enforcement of licensee and registrant duties, the establishment and operation of an originator surety fund, and miscellaneous and general provisions, such as the setting of fees and the definition of terms.

After the public comment period ends, the Department of Commerce, Community, and Economic Development will either adopt these or other provisions dealing with the same subject, without further notice, or decide to take no action on them. The language of the final regulations may be different from that of the proposed regulations. YOU SHOULD COMMENT DURING THE TIME ALLOWED IF YOUR INTERESTS COULD BE AFFECTED.
